Effective: May 29, 2026 This Acceptable Use Policy (“AUP”) sets forth certain restrictions relating to the access to, and use of, the Services by Customer or someone on Customer’s behalf under Customer’s agreement with Delphina Inc. (“Delphina”) applicable to the Services (“Agreement”). The restrictions set forth in this AUP are not exhaustive. Any capitalized terms used but not defined herein shall have the meaning set forth in the Agreement. Prohibited uses
Customer shall not (and shall not permit its authorized users to): a. attempt to access, search, or create accounts for any of Delphina’s services by any means other than Delphina’s publicly supported interfaces or as otherwise authorized by Delphina; b. use the Delphina Services to violate the security or integrity of, or otherwise abuse, any system of any party (including without limitation the Services), including but not limited to gaining unauthorized access to any system (including attempting to probe, scan, monitor, or test the vulnerability of a system), forging any headers or other parts of any message describing its origin or routing, interfering with the proper functioning of any system (including any deliberate attempt by any means to maliciously overload a system), implementing denial-of-service attacks, operating non-permissioned network services (including open proxies, mail relays or recursive domain name servers), using any means to bypass system usage limitations, or storing, transmitting or installing malicious code; c. use the Services to distribute or facilitate the sending of unsolicited or unlawful (i) email or other messages, or (ii) promotions of any kind; d. use the Services to engage in or promote any other fraudulent, deceptive or illegal activities, including accessing or using the Services from any country or territory subject to a U.S. government embargo or designated as a state sponsor of terrorism; e. use the Services to generate, store, distribute, or facilitate: (i) content that constitutes or facilitates child sexual abuse material (CSAM) or the exploitation of minors in any way; (ii) non-consensual intimate imagery or deepfake content of real individuals; (iii) content designed to harass, bully, threaten, or intimidate any individual; or (iv) content that is defamatory, harmful, or deceptive; f. use the Services to process, store or transmit material, including any Customer Data, in violation of any law or any third party rights, including without limitation privacy rights; g. use any automated tool, script, or third-party agent to scrape, extract, or systematically collect data from the Services or any content accessible through the Services, except where such access is authorized by an authorized user and conducted through the Services’ APIs or Customer’s authorized integrations; h. disclose to any third party (1) the results of any testing or benchmarking of the Services that Customer might conduct or (2) the results of any other performance-related statistics pertaining to the Services unless preapproved by Delphina in writing (except to a contractor bound to maintain the confidentiality of such information and solely for the purposes of supporting Customer’s use of the Services); i. use the Services to make or materially support decisions with legal or similarly significant effects on individuals, including decisions relating to employment, finance, healthcare, housing, insurance, education, criminal justice, or eligibility for public benefits, without appropriate human review and oversight, or otherwise use the Services for practices prohibited under applicable law, including, to the extent applicable, the EU Artificial Intelligence Act; j. use the Services to generate individualized legal, medical, financial, or other professional advice unless reviewed by a qualified professional before use or delivery; k. use the Services to predict, infer, or categorize individuals based on protected characteristics or sensitive attributes, except where permitted by law and used for fraud prevention, security, compliance, or bias testing; l. use the Services, outputs, or interactions with the Services to develop, train, fine-tune, test, or improve any product, model, or service that competes with Delphina, or to copy, replicate, or reverse-engineer any feature, function, or user interface of the Services; or resell, sublicense, or commercially redistribute access to the Services or any outputs to third parties, except as expressly permitted under the Agreement; m. use the Services in a manner that violates any applicable third-party AI provider policy or model provider terms; misrepresent the origin of any AI-generated output by claiming or implying it was created by a human; or remove any markings automatically applied to indicate content was AI-generated; n. disable, evade, disrupt, or interfere with any content filters or safety systems that are part of the Services; o. authorize agents, automated workflows, or third-party integrations to access or act through the Services without appropriate permissions, monitoring, and safeguards. Customer is responsible for all actions taken through such agents, workflows, or integrations; and p. engage in abusive, threatening, harassing, or intimidating conduct directed at Delphina personnel, whether through support channels, social media, email, or any other medium.Disclosure of AI to end users
When Customer deploys the Services in a product or service made available to end users, Customer must appropriately disclose to those end users the role of artificial intelligence in generating any outputs they receive, to the extent required by applicable law.Sensitive and regulated data
The Services are not designed for use with sensitive, restricted, or regulated data categories as may be defined in the Agreement or applicable law. Customer is solely responsible for understanding and applying any laws, regulations, and industry standards applicable to Customer’s data when using the Services.Related documents
